เมื่อเวลา 10.00 น.วันที่ 9 มีนาคม ที่ศาลอาญา ถ.รัชดาภิเษก นางพรเพ็ญ คงขจรเกียรติ ผู้อำนวยการมูลนิธิผสานวัฒนธรรม และทนายความจากศูนย์ทนายความเพื่อสิทธิมนุษยชน นายนภสินธุ์ ตรีรยาภิวัฒน์ หรือ สายน้ำ นางสาวอรวรรณ ภู่พงษ์ หรือ แบม 2 นักกิจกรรมทางการเมือง พร้อมมวลชนบางส่วน ร่วมทำกิจกรรมแสดงออกเชิงสัญลักษณ์ โดยการสวมใส่เสื้อดำถือดอกทานตะวัน ผูกริบบิ้นขาว ยื่นคำหนังสือต่อศาลอาญา เพื่อขอให้ศาลอาญาพิจารณามีคำสั่งไม่รับฝากขังครั้งที่ 4 นางสาวทานตะวัน ตัวตุลานนท์ หรือ ตะวัน และ นายณัฐนนท์ ไชยมหาบุตร หรือแฟรงค์ ผู้ต้องหา ตามประมวลกฎหมายอาญา มาตรา 116 คดีบีบแตรใส่รถขบวนเสด็จ ของพนักงานสอบสวน สน.ดินแดงอีก เพราะไม่มีความจำเป็นและเป็นการคุมขังเกินความจำเป็น ไม่เป็นไปตามประมวลกฎหมายวิธีพิจารณาความอาญา
นางพรเพ็ญ กล่าวว่า สำหรับการออกมาเคลื่อนไหวในวันนี้ เพื่อขอให้ศาลทบทวนคำสั่งเมื่อวันที่ 9 มีนาคม ที่อนุญาตให้พนักงานสอบสวนฝากขังครั้งที่ 3 ผู้ต้องหาเป็นเวลาอีก 12 วัน โดยบทบาทของตุลาการสามารถเข้าแทรกแซง และอำนวยความยุติธรรมในคำสั่งได้ทันที เรามีความเชื่อมั่นว่าแม้กระทั่งพนักงานเจ้าหน้าที่ตำรวจ มีการเขียนระบุในคำร้องขอฝากขังว่า บุคคลทั้ง 2 ซึ่งตกเป็นผู้ต้องหาในคดีตามมาตรา116 โดยพนักงานสอบสวนอ้างว่า มีการแสดงเจตนาแสดงความผิด โดยเหตุดังกล่าวนี้เชื่อว่าศาลที่เป็นผู้พิพากษารับผิดชอบสำนวนและรับผิดชอบหน้าที่ในวันนี้ จะพิจารณาถึงความจำเป็นและเหตุผลทางกฎหมาย รวมทั้งทางมนุษยธรรมว่า การปล่อยตัวโดยไม่มีเงื่อนไขการประกันตัว เป็นการแทรกแซงกระบวนการยุติธรรมที่แสดงให้เห็นว่าประชาชนยังมีความหวังกับระบบตุลาการได้โดยเฉพาะในคดีนี้ และผู้ต้องสงสัยทั้ง 2 คน เป็นเพียงเยาวชนที่ร่วมกันแสดงอารยะขัดขืนในการอดอาหารด้วยความสงบ ไม่สามารถทำร้ายใคร ไม่สามารถที่จะทำให้เกิดความรุนแรงในสังคมด้วยวิธีการใดๆ ดังนั้นเหตุและผลที่เราต้องการนำเสนอ คือ ข้อเท็จจริงกฎหมาย และมนุษยธรรม ซึ่งผู้พิพากษาเป็นนักกฎหมายด้วยกัน สามารถพิจารณาเนื้อหาสาระได้อย่างมีความเป็นธรรม เพื่อให้ประชาชนเชื่อมั่นในระบบตุลาการต่อไป
ด้านนางสาวอรวรรณ หรือแบม ระบุว่า ผู้หญิงในสังคมนี้เข้มแข็งและอดทนกันมาก พลังผู้หญิงสำคัญในการขับเคลื่อนสังคมเป็นอย่างมาก ตนอยากจะพูดถึงเรื่องกระบวนการยุติธรรม อยากให้ทุกคนในประเทศนี้ได้รับความยุติธรรม สำหรับตะวันและแฟรงค์ที่ทำทุกวันนี้ไม่ได้ทำเพื่อตัวเอง แต่เป็นการทำเพื่อไม่อยากให้ใครมาเจอกับเหตุการณ์แบบนี้ เพราะกระบวนการยุติธรรมที่บิดเบี้ยวทำร้ายประชาชนและเยาวชนในประเทศนี้ เราควรจะปฏิรูปกระบวนการยุติธรรมไม่ว่าเร็วหรือช้าจะต้องทำให้ได้ เพราะประเทศไทยยังมีปัญหาเรื่องสิทธิเสรีภาพในการแสดงออกอย่างมาก และประเทศไทยไม่สมควรที่จะได้เป็น คณะมนตรีสิทธิมนุษยชนแห่งสหประชาชาติ เพราะทุกวันนี้ยังมีผู้ต้องขังและคนถูกดำเนินคดีเพิ่มขึ้นมากขึ้น และประชาชนที่ถูกปิดปากมากขึ้นทุกวัน ทั้งที่เรามองเห็นและมองไม่เห็น
ทั้งนี้ตามกฎหมายให้ศาลพิจารณาตามสมควร ของการฝากขังเพื่อกลั่นกรอง ให้เกิดความยุติธรรม ไม่ใช่รับฝากขังทุกครั้ง เราจึงยอมให้อำนาจตำรวจในการตัดสินใจเอง และศาลไม่จำเป็นที่จะต้องเห็นด้วยกับตำรวจทุกครั้ง และตราบใดที่กระบวนการยุติธรรมอย่างบิดเบี้ยว ทุกคนสามารถเจอเรื่องแบบนี้ได้ทุกคดี
“ขอเป็นกำลังใจให้กับนักกิจกรรมที่เผชิญกับความยากลำบากในการอดอาหาร สุดท้ายกระบวนการยุติธรรมยังบิดเบี้ยว ทุกคนในสังคมบอกว่า แค่ให้น้องกินอาหารกินน้ำ และเข้าสู่กระบวนการยุติธรรม แต่สำหรับพวกเขาเหล่านี้มองว่าหิวความยุติธรรมมากกว่า นอกจากนี้ขอย้ำ 3 ข้อเรียกร้อง คือ ต้องปฏิรูปกระบวนการยุติธรรม / ต้องไม่มีใครติดคุกเพราะเห็นต่าง / ประเทศไทยไม่ควรเป็นคณะมนตรีสิทธิมนุษยชน และหลังจากนี้เราจะมีกิจกรรมยืนหยุดขัง 1.12 ชั่วโมง”
