มติศาลรัฐธรรมนูญ พิธา “ถือหุ้นไอทีวี” แต่ไม่พ้น สส. เพราะไม่ถือเป็นสื่อ
ศาลรัฐธรรมนูญมีมติ 8 ต่อ 1 ว่า นายพิธา ลิ้มเจริญรัตน์ เป็นผู้ถือหุ้นไอทีวีในวันสมัครรับเลือกตั้ง แต่ไม่พ้นสมาชิกภาพ สส. เนื่องจากบริษัท ไอทีวี จำกัด (มหาชน) ไม่ได้ประกอบกิจการหรือมีรายได้จากกิจการหนังสือพิมพ์หรือสื่อมวลชนใด ๆ
เวลา 13.55 น. ตุลาการศาลรัฐธรรมนูญออกนั่งบัลลังก์เพื่ออ่านคำวินิจฉัย เรื่องคณะกรรมการการเลือกตั้ง (กกต.) ขอให้วินิจฉัยตามรัฐธรรมนูญ มาตรา 82 ว่าสมาชิกภาพ สส. ของนายพิธา ลิ้มเจริญรัตน์ สิ้นสุดลงตามรัฐธรรมนูญ มาตรา 101 (6) ประกอบกับมาตรา 98 (3) หรือไม่ จากกรณีถือหุ้นในบริษัท ไอทีวี จำกัด (มหาชน) จำนวน 42,000 หุ้น ซึ่งประกอบกิจการหนังสือพิมพ์หรือสื่อมวลชนใด ๆ อยู่ในวันสมัครรับเลือกตั้ง สส.บัญชีรายชื่อ เมื่อ 4 เม.ย. 2566 โดยใช้เวลา 40 นาที
“ณ วันที่ผู้ถูกร้องสมัครรับเลือกตั้ง สส. บริษัทไอทีวีไม่ได้ประกอบกิจการหนังสือพิมพ์ หรือสื่อมวลชนใด ๆ การถือหุ้นไอทีวีของผู้ถูกร้อง (นายพิธา) จึงไม่ทำให้มีลักษณะต้องห้ามไม่ให้ใช้สิทธิสมัครรับเลือกตั้ง ตามรัฐธรรมนูญ มาตรา 98 อนุสาม สมาชิกภาพของ สส. ของผู้ถูกร้องไม่สิ้นสุดลงตามรัฐธรรมนูญ” คำวินิจฉัยของศาลรัฐธรรมนูญระบุตอนหนึ่ง
สำหรับตุลาการเสียงข้างน้อย 1 คนที่เห็นว่า สมาชิกภาพ สส. ของนายพิธาสิ้นสุดลงคือ นายนครินทร์ เมฆไตรรัตน์ ว่าที่ประธานศาลรัฐธรรมนูญคนใหม่
