ศาลสูงรัฐโคโลราโด ตัดชื่อ ‘ทรัมป์’ ออกจากบัตรเลือกตั้งปธน. ขั้นต้น
เมื่อวันอังคารตามเวลาท้องถิ่น ศาลสูงรัฐโคโลราโดตัดสิทธิ์อดีตประธานาธิบดีโดนัลด์ ทรัมป์ จากการลงชิงตำแหน่งประธานาธิบดี และตัดชื่อของเขาออกจากบัตรเลือกตั้งประธานาธิบดีขั้นต้นในรัฐโคโลราโด ด้วยข้อหาสนับสนุนการก่อจลาจลที่อาคารรัฐสภาสหรัฐฯ เมื่อวันที่ 6 มกราคม 2021 ซึ่งทางศาลเห็นว่าเป็นการขัดต่อรัฐธรรมนูญ ตามรายงานของเอพี
คณะตุลาการที่ถูกแต่งตั้งโดยผู้ว่าการรัฐจากพรรคเดโมแครต ลงมติ 4-3 ในคำตัดสินดังกล่าว ซึ่งถือเป็นครั้งแรกในประวัติศาสตร์ที่มีการใช้มาตราที่ 3 ของบทแก้ไขรัฐธรรมนูญสหรัฐฯ ฉบับที่ 14 เพื่อตัดสิทธิ์ผู้ลงชิงตำแหน่งประธานาธิบดี
ในวันพุธ ประธานาธิบดี โจ ไบเดน กล่าวกับผู้สื่อข่าวกรณีคำตัดสินนี้ว่า แน่นอนหลักฐานแสดงให้เห็นว่าทรัมป์ทำผิดด้วยการสนับสนุนการก่อจลาจลจริง และว่า “การที่บทแก้ไขรัฐธรรมนูญสหรัฐฯ ฉบับที่ 14 จะถูกนำมาใช้หรือไม่นั้น ขึ้นอยู่กับดุลยพินิจของศาลสูง”
มาตราที่ 3 ของบทแก้ไขรัฐธรรมนูญฉบับที่ 14
กฎหมายยุคหลังสงครามกลางเมืองเมื่อเกือบ 160 ปีที่แล้วนี้ ถูกออกแบบเพื่อป้องกันไม่ให้สมาชิกของอดีตสมาพันธรัฐอเมริกา (Confederate States of America) ซึ่งเป็นฝั่งตรงข้ามของรัฐบาลกลางสหรัฐฯ ให้กลับมาดำรงตำแหน่งของรัฐบาลได้ หลังสงครามกลางเมืองยุติลง
กฎหมายดังกล่าวระบุว่า ผู้ใดก็ตามที่สาบานตนว่าจะสนับสนุนรัฐธรรมนูญ แต่กลับ “เข้าร่วมก่อการจลาจลหรือก่อกบฏ” ในเวลาต่อมา จะไม่สามารถกลับมาดำรงตำแหน่งในรัฐบาลได้อีก โดยมีการบังคับใช้กฎหมายนี้เพียงไม่กี่ครั้งในช่วงยุคหลังสงครามกลางเมือง
คำตัดสินของศาลสูงรัฐโคโลราโดในครั้งนี้ยังเป็นการกลับคำตัดสินของผู้พิพากษาศาลแขวงในหลายรัฐที่เห็นว่า ทรัมป์ยั่วยุให้เกิดการจลาจลจากบทบาทของเขาในเหตุการณ์ที่อาคารรัฐสภาสหรัฐฯ จริง แต่ทรัมป์ไม่อาจถูกตัดชื่อออกจากบัตรเลือกตั้งได้เนื่องจากยังไม่แน่ชัดว่ากฎหมายดังกล่าวมีเจตนาครอบคลุมสถานะการเป็นประธานาธิบดีหรือไม่
ทั้งนี้ ศาลสูงโคโลราโดจะยังไม่ดำเนินการทางกฎหมายต่อไปจนกว่าศาลสูงของสหรัฐฯ ในกรุงวอชิงตัน จะมีคำพิพากษาในวันที่ 4 ม.ค. ขณะที่เจ้าหน้าที่รัฐโคโลราโดเผยว่า จะต้องหาข้อยุติในประเด็นนี้ให้ได้ภายในวันที่ 5 ม.ค. ซึ่งเป็นวันสุดท้ายที่รัฐโคโลราโดจะจัดพิมพ์บัตรเลือกตั้งประธานาธิบดีขั้นต้น
ศาลสูงรัฐโคโลราโดระบุในคำพิพากษาด้วยว่า ทางศาลพิจารณาอย่างถี่ถ้วนต่อการทำหน้าที่ใช้กฎหมายโดยปราศจากอคติ และไม่หวั่นไหวไปกับท่าทีของสาธารณชนต่อผลจากคำตัดสิน
บทบาทศาลสูงอเมริกัน
ที่ผ่านมา ศาลสูงสหรัฐฯ ยังไม่เคยมีคำตัดสินในคดีที่เกี่ยวกับมาตราที่ 3 โดยตุลาการศาลสูงสามารถพิจารณาคดีนี้ได้ทันทีที่คณะทนายความของทรัมป์ยื่นอุทธรณ์มา ซึ่งคาดว่าจะยังไม่ใช่ในสัปดาห์นี้
